Terms of use
Quality Days is an iPhone app made by one independent developer. An account is optional; with one, your plan follows you between phones and you can publish training plans for other runners. Using the app means you accept what follows, and creating an account or publishing a plan means you accept the parts about them.
What you get
You get a personal, non-transferable licence to use Quality Days on Apple devices you own or control, for as long as you keep it installed. The app and its contents stay our property. You may not sell it, rent it, decompile it or pull it apart to build something from it, except where the law says you may regardless of this paragraph.
This is not medical advice
Quality Days is a training tool, not a medical device. It reads figures your iPhone and watch recorded and does arithmetic on them. Nothing it shows is a diagnosis, a health assessment, or advice about whether you should train, rest, race or see a doctor.
Training plans in the app, whether they ship with it or were written by another runner, are schedules written for nobody in particular. A plan published by a runner is that runner's opinion and nothing more; we have not checked it and do not endorse it. Paces, loads and thresholds are estimates derived from your own past runs and they can be wrong. Use your judgement, and talk to a qualified professional before starting or changing a training programme, especially if you have a health condition, are recovering from injury, or are new to running. If something feels wrong while you are running, stop.
Accuracy
Every number in the app comes from Apple Health, which in turn gets it from your iPhone, your watch, or whatever app wrote it there. GPS drifts, heart-rate straps slip, watches miss samples, and a workout recorded twice will look like two workouts until the app merges it. Forecasts come from Apple WeatherKit and are forecasts. The app does not promise any of it is right, and you should not rely on it for anything that matters more than a training decision.
No warranty
The app is provided as is and as available, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. There is no promise that it will be uninterrupted, error free, compatible with a future version of iOS, or that any particular feature will keep working or keep existing.
Limits on liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss arising from your use of the app, including injury, lost data, lost time or a disappointing race. Some jurisdictions do not allow limits like this, in which case the limit applies as far as it legally can and no further, and nothing here affects rights you have as a consumer that cannot be waived.
The Apple licence
Quality Days is distributed through the App Store. Unless we supply a separate licence agreement, the app is licensed to you under Apple's Licensed Application End User License Agreement, the standard EULA, and these terms sit alongside it. Where the two disagree, the Apple standard EULA governs for anything it covers.
Three terms from it apply directly here. The licence is between you and us, not you and Apple. Apple has no obligation to provide support or maintenance for the app. Apple and its subsidiaries are third-party beneficiaries of that agreement and may enforce it against you.
Accounts
An account is optional. You can use every part of the app without one. If you create one, you are responsible for the address and password you use and for what happens under the account. One account has one way in: Sign in with Apple, Google, or an email address and password. You must be at least 13 to create an account, and at least the age at which you can agree to terms like these where you live.
You can delete the account at any time from Settings. Deletion is immediate and total on the server; plans you published are withdrawn and no longer carry your name. Nothing on your phone is touched.
Community plans
Runners can write training plans and publish them for other runners to use. When you publish a plan you give us and every runner using the app a licence to show, copy, store and follow it, in the app, for as long as it stays published and for runners already following it after that. It stays yours. You may withdraw it at any time; runners who already applied it keep their copy.
You may only publish plans you wrote or have the right to publish. A plan copied from a book, a coach or another runner without permission may be withdrawn on a report.
Zero tolerance for objectionable content. A published plan is text and numbers about running. It may not contain abuse, harassment, hate, threats, sexual content, spam, advertising, or content that is dangerous to follow. Any plan can be reported from inside the app, and any runner can be blocked, which hides everything they publish from you. Every report is reviewed within 24 hours of arriving, and a plan or an account that breaks this paragraph is removed. Contact for anything that needs a person: support@qualitydays.app.
We may withdraw a plan, suspend publishing, or close an account that breaks these terms, and will tell the author which complaint led to it. Withdrawing a plan does not delete it from the phones of runners already following it, because they are mid-block on it.
Your data
Without an account the app holds your data on your device and sends none of it anywhere. With an account, today the service holds the plan you applied, a summary of each run and the plans you write, so a second phone can agree with the first. If the service ever needs more than that, the privacy policy and its effective date change first and the app asks before sending anything new. The privacy policy is part of these terms.
Changes and ending it
These terms may change as the app does. The effective date above will change with them, and continuing to use the app after that means you accept the new version. You can end this agreement whenever you like by deleting the account from Settings and deleting the app, which together delete everything the app and the service held for you.
